Conservative Supreme Court Justice Antonin Scalia died Saturday and it is a major bummer. Not just because he was the standard bearer for conservative jurisprudence, but also because it gives Obama the opportunity to shift the political and ideological balance of the court. With 4 conservative judges and 4 liberal ones, the next person appointed to the Supreme Court will decide which way it leans. If Obama is able to install another whacko leftist like his previous appointees, our gun ownership rights are in serious jeopardy.
It sucks having a democrat for a president. It sucked having a democratic Senate and House back in the day. Democrats hate guns and don’t respect the 2nd Amendment and when they are in power, they use it to subvert our gun ownership rights. But the thing is, anti-gun laws passed by democrats can be overturned, nullified, and replaced. Democrats can be voted out of office in favor of sane pro-liberty politicians.
With a liberal Supreme Court, what they rule is the end of the discussion. Their decisions cannot be overturned and they cannot be voted off the bench. If the highest court in the land says something is constitutional or unconstitutional, that’s what it is.
If a liberal majority Supreme Court decided that we don’t have a right to gun ownership, there’s nothing short of a revolution to change that. If they feel that assault weapons bans and magazine capacity limits are allowed under the law, we can no longer own those things. If a liberal court says we do not have a right to carry concealed weapons, we can’t carry concealed weapons.
Making this scenario truly terrifying is that there are dozens of important gun rights cases at various levels of appeal in the United States right now. Should a lefty nutjob Justice be allowed to replace Scalia, the Supreme Court would take these cases and rule against the 2nd Amendment and the American gun owner.
For as much fear as Obama has caused concerning gun ownership during his presidency, our gun rights have never been in peril like they are at this very moment. If he is able to put the judge of his choice on the bench, we are doomed.
The good news is that we have Republicans in control of the Senate and they are the ones who approve of the president’s Supreme Court nominations. In theory, the Senate could block an Obama nominee until he mercifully leaves the White House. I say “in theory” because the Republicans have generally not stood up to Obama and his evil agenda.
If the Senate blocks Obama’s nominee, it is vitally important that the next President of the United States is a Republican, because a democrat is going to put an anti-gun liberal activist judge on the bench. Blocking Obama’s nominee only to have Bernie Sanders or Hillary Clinton come in is just as bad.
Some potentially bad news is that Obama has a Constitutionally gray opportunity to put a liberal on the Supreme Court without Senate confirmation. Conceivably he could make the appointment while Congress is not in session. The appointment could be fought, but he’d get the judge of his choice installed and it would be hard to remove him or her. There is a window of opportunity for Obama to do this over the next two weeks and we all know how much he likes bypassing the Congress.
Whatever happens with this over the next couple of weeks and months could very well determine if we have a Constitutional right to keep and bear arms. Either we stay as the country our Founding Father built or we become Australia. Which one do you think gun-hating Obama wants?
