A black man was on trial for attacking police officers and had an all-white jury, which is normally considered systemic racism. Lucky for him this jury was all liberal white people from San Francisco. He was found not guilty, not because he was innocent, but rather because this panel of leftists felt there is too much racism in the country and the fact that the accused was black was excuse enough for him to attack cops.
SFGate reports that 22-year-old Michael Smith and his girlfriend were riding the train in SF last July. The two black people said that a white man on the train told them they smelled bad and asked them to move. Whether or not that is true is irrelevant. What happened next is that Smith got in an argument with them man and became aggressive. The white man called the police to report Smith was threatening him and may be armed.
The Bay Area Rapid Transit (BART) police responded to a call in which they thought Smith was threatening a person with a gun. When they confronted Smith they had their guns drawn and ordered him and his girlfriend to get on the ground. Not only did Smith refuse the officer’s commands, he attacked them when they tried to arrest him. There is both police body-cam footage and bystander video showing Smith resisting arrest and fighting with the officers.
Smith was charged with 6 counts of battery on an officer and one count of resisting arrest. He was acquitted of four of those charges and the judge declared a mistrial on the others.
Now here’s the astounding reason why:
None of the jurors selected in the trial was African American. But juror John Mayhew said afterward that the underlying racial dynamics were clear.
“One of the officers had made a comment about how the minute he saw (Smith), he looked angry and he had a furrowed brow. I didn’t see that from the video, and it spoke to a certain amount of bias. This person looked a certain way and you were willing to react a certain way,” said Mayhew.
The jurors struggled with whether Smith resisted arrest, Mayhew said, when he refused to get on the ground after the officers approached him with their guns drawn. Mayhew said several jurors spoke of recent police shootings across the nation and could imagine that Smith was thinking he might be in danger.
If Smith was thinking he was in danger, why did he believe that attacking armed police officers was the best way to reduce the threat?
“From the moment when they said, ‘Get down, get down,’ and he said no, it was only 10 seconds. They didn’t give him time to process what was asked of him, and right now, if you’re African American, this is part of your life, part of your story,” Mayhew continued.
Really? 10 seconds isn’t enough time to process the very simple order of “get down” given by a cop with his gun drawn?
“I believe with all my heart that if that call had been about me, a 52-year-old white male, they would not have approached me the way they did, with their guns drawn,” concluded Mayhem.
There you have it: a black guy was acquitted by an all-white jury for crimes he most certainly committed because perceived racism excuses black people from following the law. They literally let this guy off simply for being black.
