Actually I don’t know that my headline is completely accurate, but we are dealing with a leftist lunatic so anything is possible. New York Governor Andrew Cuomo says he’s going to sue if the Supreme Court rolls back Roe v. Wade, the decision that legalized abortion. The question is, who is he going to sue? Maybe he thinks he can sue the Supreme Court, which of course he can’t. Other than that, I can’t quite figure out who or what he intends on suing.
Here’s the least informative news report of all time from ABC 10:
New York Governor Andrew Cuomo says he’ll sue if the Supreme Court rolls back Roe v. Wade.
Gov. Cuomo has been calling on lawmakers to increase protections in New York.
“We never passed the New York State law because we relied on Roe v. Wade and everyone assumed it would always be there,” Gov. Cuomo said.
During the 2016 election, Donald Trump regularly stated that he would only appoint judges to the Supreme Court that would overturn the ruling.
On Monday, President Trump nominated Judge Brett Kavanaugh to the Supreme Court. The Senate still has to approve the nomination.
Democrats are pushing for a vote on the nomination until after the mid-term elections.
That is the entire extent of News 10’s coverage. Most of it is not even related to the most interesting thing, which is Cuomo threatening to sue. Didn’t anyone at News 10 think to ask: who? Seriously, who the hell is Cuomo going to sue if the Supreme Court rolls back Roe v. Wade.
There’s an awful lot wrong here, so let’s just start at the top. The Supreme Court doesn’t roll back anything, they simply interpret the constitutionality of issues. They have already weighed in on abortion and deemed it to be protected under the law. There is no revisiting this. The decision has been made and the only way to change it is with Congress passing a Constitutional amendment, which seems unlikely.
Also, the Supreme Court doesn’t “try” to do things. They make decisions and that’s it. It’s not like they would make several attempts to “roll back” Roe v. Wade, giving Cuomo a heads up to file his lawsuit.
Which brings us to the thereat to sue. I know that Cuomo is a lunatic and it’s hard to gauge what he’s talking about, but I honestly believe he thinks he will sue the Supreme Court. I could go into a bunch of stuff, but it’s easier like this: Type into Google “Can someone sue the Supreme Court?” After Google laughs at you for asking such a stupid question it tells you about “Sovereign Immunity” which basically means that no, you can’t sue the government including the Supreme Court.
Andrew Cuomo is part of the government and a lawyer so surely he’s familiar with sovereign immunity, right? Maybe not. He thinks he’s an illegal alien based on the fact that he was born in the United States but that his family had legally immigrated to the US.
If Cuomo is looking to sue the person responsible for Brett Kavanaugh being nominated to the Supreme Court, there are a couple potential targets. If Obama wasn’t such a shitty president and if Hillary Clinton hadn’t run such a shitty campaign, Donald Trump would have never been President and therefore wouldn’t be in a position to to make SCOTUS nominations. I would actually support Cuomo if he sued Obama and Hillary for any reason.
